Terms of Service

1. Entertainment-Only Experience

Regular Picks is a fan engagement platform designed to enhance the in-venue experience for bars, restaurants, and similar hospitality partners. The product, website, mobile experience, notifications, and any downloadable materials (collectively, the “Service”) are provided for amusement and community-building purposes only.

We do not offer, promote, or facilitate sports wagering, gambling, betting pools, daily fantasy sports, lotteries, or any other activity where money or other things of value are risked on the outcome of sporting events.

2. Informational Content

All scores, schedules, lines, odds, analysis, and other data surfaced by the Service are provided strictly for informational display. We make no promises that any information is accurate, up-to-date, or suitable for your intended use. Do not rely on the Service for placing wagers, calculating financial outcomes, or making business decisions.

3. No Entry Fees, Prize Pools, or Payouts

Regular Picks does not collect entry fees, manage prize pools, escrow funds, or distribute winnings and prizes. Any optional incentives, giveaways, or rewards you encounter are offered solely by the hosting venue or organizer (“Host”), and not by Regular Picks.

If you choose to participate in a Host-created contest, all terms, eligibility rules, prize descriptions, tax reporting, and fulfillment obligations are the sole responsibility of that Host.

4. User Accounts & Conduct

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree not to misuse the Service, attempt to circumvent security measures, or engage in behavior that disrupts the experience for other participants or venues.

5. Venue Responsibilities

Hosts are responsible for verifying that their use of the Service complies with all applicable laws, regulations, and venue policies. Hosts control who may participate, how participation is limited to on-premise guests, and what local incentives (if any) are provided.

Regular Picks disclaims any liability arising from a Host’s promotional practices, house rules, marketing claims, or prize fulfillment.

6. Disclaimer of Warranties

The Service is provided “as is” and “as available” without warranties of any kind, whether express or implied. We expressly disclaim all implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not guarantee uninterrupted or error-free access to the Service, nor do we warrant that defects will be corrected or that the Service is free of viruses or other harmful components.

7. Limitation of Liability

To the fullest extent permitted by law, Regular Picks, its owners, employees, contractors, and affiliates will not be liable for any indirect, incidental, special, consequential, punitive, or exemplary damages arising out of or relating to your use of the Service.

If a court determines that liability cannot be excluded, our maximum aggregate liability will not exceed one hundred U.S. dollars ($100) or the amount you paid to Regular Picks in the past twelve (12) months, whichever is less.

8. Indemnification

You agree to indemnify, defend, and hold harmless Regular Picks and its affiliates from any claims, damages, liabilities, and expenses (including reasonable attorneys’ fees) arising out of or related to your misuse of the Service, your violation of these Terms, or any dispute between you and a Host or other participant.

9. Eligibility; Local Laws

You may use the Service only where it is lawful to do so. You are responsible for ensuring compliance with local, state, federal, and international laws that apply to your access to, and participation in, Regular Picks.

If you are under the age of majority in your jurisdiction, you may only use the Service with the consent of a parent or legal guardian.

10. Changes to the Service or Terms

We may modify the Service, update these Terms, or discontinue features at any time. When material changes are made, we will update the “Last Updated” date below. Continued use of the Service after an update constitutes acceptance of the revised Terms.
